Voluntary Field Sobriety Tests

When drivers are stopped on suspicion of driving under the influence (DUI), cops can ask them to take standardized field sobriety tests (SFSTs). SFSTs include the horizontal gaze nystagmus examination (HGN), the walk-and-turn (WAT), and the one-leg-stand (OLS).

Sound like hocus pocus? In many ways, they are. But, unfortunately, the courts have found that if conducted properly, the HGN, WAT, and OLS can be admitted at trial and used by the State to show a driver was under the influence of alcohol to the extent they were less safe to drive.

What a lot of drivers don’t realize is that SFSTs are voluntary. You don’t have to take them.
